1. Agreement
By engaging AVIRA HOMES for any construction or building services, you enter into a formal agreement with us. This agreement outlines the scope, fees, and specific terms for your project.
2. Services Provided
We offer custom home building, renovations, extensions, and project management services. All services will be agreed upon in writing before commencement, with project timelines, milestones, and costs detailed in the contract.
3. Payment Terms
A deposit is required before any work begins, with further payments made according to the agreed-upon payment schedule. All invoices must be paid in accordance with the terms specified in the contract. Late payments may incur additional fees.
4. Responsibilities
- AVIRA HOMES: We will perform the services with due care, in accordance with relevant building codes and regulations. We will provide you with progress updates and ensure that the work is completed on time and within budget.
- Client: You are responsible for providing us with accurate information, ensuring the site is accessible, and making payments as agreed.
5. Building Code Compliance
We comply with all relevant Australian building codes, laws, and local council requirements. AVIRA HOMES is fully licensed and insured to operate as a custom home builder in Melbourne.
6. Changes to the Agreement
Any changes to the project, including design modifications, cost adjustments, or changes to the completion date, will be agreed upon in writing between AVIRA HOMES and the client. Additional charges may apply for changes outside the original scope of work.
7. Warranty
We provide a warranty on all our work as required by Australian law. This warranty covers defects in materials and workmanship, and any issues must be reported within the specified warranty period. Full details of the warranty will be provided upon contract signing.
8. Liability
AVIRA HOMES will not be liable for any delays caused by factors outside of our control, such as weather, supply chain disruptions, or actions of third parties. Our liability is limited to the value of the services provided.
9. Dispute Resolution
If a dispute arises, we will work with you in good faith to resolve the issue. If necessary, we agree to engage in formal mediation or arbitration to settle any unresolved disputes.
10. Termination
Either party may terminate the agreement if there is a breach of contract. Upon termination, the client is responsible for any work completed up to the point of termination, and any deposits made are non-refundable.
11. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia. Any legal actions will be subject to the jurisdiction of Australian courts.
